1. Introduction and Acceptance

Welcome to Dark Tantra Temple. These Terms of Service (the "Terms") govern your use of the Dark Tantra Temple website at darktantratemple.com, the member portal, our applications, courses, events, and any related products or services we offer (together, the "Services"). The Services are operated by Dark Tantra Temple LLC ("Dark Tantra Temple," "DTT," "we," "us," or "our").

By creating an account, by submitting an application, by purchasing a ticket, or by otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

Please read these Terms carefully. They include important provisions about dispute resolution, including a binding arbitration agreement and a class-action waiver, with a thirty-day opt-out window described in Section 18.

2. Eligibility

Dark Tantra Temple is an adult-only community. To use the Services you must be at least twenty-one years old and have the legal capacity to enter into a binding contract under the laws of your jurisdiction.

You must not use the Services if you have been previously removed from the Dark Tantra Temple community for a violation of these Terms, of our Privacy Policy, or of our Community Policy, unless we have notified you in writing that your access has been restored.

By using the Services, you represent and warrant that you meet these eligibility requirements.

3. Account Terms

To access most parts of the Services you must create an account. When you create an account, you agree to provide accurate, current, and complete information about yourself, and to keep that information up to date. You are responsible for any activity that takes place under your account.

You are responsible for keeping your account credentials confidential. You may not share your password, share your account, or allow another person to access the Services through your account. If you believe your account has been used without your authorization, please contact us immediately at temple@mail.darktantratemple.com so that we can help secure it.

We may suspend or close any account that we reasonably believe has been used in violation of these Terms, our Privacy Policy, or our Community Policy, or that has been used in a way that puts the community at risk.

4. Membership Terms and Tiers

Dark Tantra Temple is a community for adults exploring tantric practice, somatic embodiment, conscious intimacy, and related personal-growth modalities. Participation moves through several stages.

Some Services are tier-gated. In particular, our Consent and Etiquette course must be completed before you can register for certain member-tier events. Course completions are recorded on your account and may need to be refreshed periodically.

We reserve the right to suspend or terminate membership for cause, including violation of these Terms, violation of our Community Policy, or behavior that places the community at risk. Section 12 describes the conduct standards in more detail; Section 14 describes termination.

  • Interested. You have created an account and are considering applying for membership. You can browse public information, sign up for open-tier events, and start the application when you are ready.
  • Applicant. You have submitted a membership application. Our team reviews applications in the order received.
  • Member. Your application has been approved. You have full access to member-tier features subject to the requirements described below.
  • Community role-holder. Members may apply for additional community roles such as Temple Keeper, Temple Monitor, or Facilitator. Each role has its own application form and review process.
  • Administrator. Dark Tantra Temple staff and operators of the Services.

5. Event Participation Terms

Dark Tantra Temple hosts in-person and online events. By signing up for an event, you agree to follow the event-specific instructions communicated to you and to abide by our Community Policy at darktantratemple.com/community-policy.

Some events are open to anyone with an account. Other events require active membership and a current Consent and Etiquette course completion before you may register. The requirements for a given event are listed on its event page.

Check-in is required at every in-person event. Bring the email confirmation or display the ticket in your account on a phone. Staff may verify your identity and your account status at the door. If your account does not show an active ticket or other authorization to attend, you will not be admitted.

Dark Tantra Temple reserves the right to refuse entry to, or to remove from an event, any attendee whose conduct violates our Community Policy or whose presence places the safety of the community at risk. Refusal of entry or removal does not entitle you to a refund except as described in Section 8.

6. Payment Terms

Tickets, add-ons, and other paid products are sold through the Services in United States dollars. Prices are shown at checkout. Applicable taxes, if any, are added at checkout.

  • Card payments. Card payments are processed by Stripe under Stripe's terms of service. Dark Tantra Temple does not see or store your full card number; we receive a confirmation of payment from Stripe.
  • Other supported payment methods. Where offered, Dark Tantra Temple may accept cash, Venmo, Zelle, complimentary issuance by an administrator, or redemption of voucher credit. Section 7 describes voucher terms. Section 11 describes which methods are available at the door.
  • Authorization. By submitting a payment, you authorize Dark Tantra Temple, our payment processor, or your payment provider to charge the payment instrument you provide for the amount listed at checkout plus any applicable taxes.

If a payment fails, is reversed, or is otherwise not honored, we may suspend your access to the related ticket or product and may charge you for any fees we incur as a result.

7. Voucher Terms

From time to time, Dark Tantra Temple may issue voucher credit (each, a "Voucher") to a member as a courtesy. Vouchers are not gift cards and have no cash value.

  • Issuance. Vouchers are issued at the discretion of Dark Tantra Temple administrators. They cannot be purchased.
  • Non-transferable. Vouchers are tied to the recipient member's account. They cannot be transferred, gifted, sold, or assigned to another person.
  • Non-refundable for cash. Vouchers cannot be exchanged for cash, check, store credit unrelated to the Services, or any other form of consideration.
  • Redemption. Voucher credit may be applied during online checkout to reduce the amount due on a ticket. Voucher credit may not be applied to a ticket within one hour of the event start, and voucher credit may not be applied to at-the-door payments.
  • Account closure. Vouchers remain redeemable as long as your account is active. If your account is closed for any reason, by you or by us in accordance with these Terms, any remaining voucher balance is forfeited and cannot be redeemed or refunded.
  • Refund interaction. If a ticket purchased with voucher credit is refunded, the voucher portion of the refund is restored to your voucher balance in the same proportion in which it was applied. The cash portion of the refund is returned to the original payment method as described in Section 8.

Vouchers are a courtesy, not a payment instrument. We reserve the right to revoke or invalidate vouchers that we believe have been issued in error or obtained through fraud.

8. Refund Policy

Tickets and add-ons are sold for specific events. Whether a refund is available, and the amount of any refund, is determined by Dark Tantra Temple in our reasonable discretion based on the circumstances of the request, the timing relative to the event, and applicable law.

Complimentary tickets and tickets issued as a courtesy without a cash payment are not refundable for cash. If you would like a refund of a paid ticket, please contact us at temple@mail.darktantratemple.com.

When we issue a refund, the cash portion is returned to the original payment method. Card refunds processed through Stripe typically settle within three to ten business days, depending on your card issuer. The voucher portion of a refund, if any, is restored to your voucher balance as described in Section 7.

Refunds for events canceled by Dark Tantra Temple are addressed on a per-event basis. We will communicate the available remedies to ticket holders when we cancel an event.

9. Affiliate Program Terms

Dark Tantra Temple operates an affiliate program that pays commissions to participating members on qualifying ticket sales referred through their affiliate code.

  • Eligibility. Affiliates must be active members in good standing. We may decline an application or terminate participation for any reason consistent with these Terms.
  • Commission rate. The standard commission tier pays fifteen percent (15%) on qualifying referred sales as of the effective date of these Terms. The commission rate that applies to a given referral is recorded with the referral for audit purposes. Current rates are listed in the affiliate dashboard in the member portal at /portal/affiliate.
  • Qualifying sales. A sale qualifies for commission when the buyer completes checkout with your affiliate code and the order is fulfilled. Refunded orders may reduce a previously credited commission.
  • Payouts. Commission payouts are processed on a periodic basis at our discretion. Pending and paid commission balances appear in your affiliate dashboard.
  • Taxes. You are responsible for any taxes owed on commissions you receive. We may request a completed tax form before issuing payouts.
  • Permitted promotion. You may promote Dark Tantra Temple through your own channels using accurate, current information. You may not impersonate Dark Tantra Temple, run paid advertising on our trademarks without our written consent, send unsolicited bulk messages on our behalf, or make misleading claims about the Services.

We may modify the affiliate program, change commission rates, or end the program with notice. Modifications apply to referrals that occur on or after the effective date of the change.

10. Waitlist and Reservation Terms

When an event is at capacity, you may be able to join a waitlist on the event page.

  • Priority. Waitlist position is assigned at the time you join, in the order received.
  • Manual promotion. Promotion from the waitlist is at the discretion of Dark Tantra Temple staff. Cancellations by other attendees do not automatically promote the next person on the waitlist.
  • Reservations. When we promote you from the waitlist, we may either issue a complimentary ticket directly to your account or send you a reservation link that lets you complete checkout for that ticket. Reservations expire twenty-four hours after issuance. After that time, the reservation may be released and the slot offered to the next person on the waitlist.
  • No guarantee. Joining a waitlist does not guarantee that you will be promoted, that a ticket will become available, or that you will be able to attend the event.

11. At-the-Door Payment Terms

At certain events, Dark Tantra Temple staff and authorized community role-holders, including Temple Monitors and Temple Keepers, may accept payment at the door for an available ticket.

  • Active account required. All attendees must hold an active Dark Tantra Temple account before payment can be accepted at the door. Walk-up registrations are not permitted; if you arrive without an account, you will be asked to create one at darktantratemple.com before payment.
  • Accepted methods at the door. At-the-door payments may be made with cash, Venmo, Zelle, or by complimentary issuance at the discretion of authorized staff. Card payments are not accepted at the door in this version of the Services.
  • Vouchers not applied at the door. Voucher credit may only be applied during online checkout. It cannot be applied to an at-the-door payment.
  • Receipts. A confirmation email is sent to the account email on file after an at-the-door payment is recorded.

12. Conduct and Community Standards

Dark Tantra Temple is built on consent, autonomy, confidentiality, and care. Our Community Policy at darktantratemple.com/community-policy describes the agreements that guide how we participate together, both online and at events. By using the Services, you agree to follow our Community Policy.

Conduct that may result in immediate suspension or termination of your account and your participation in the community includes, but is not limited to: harassment of any member or guest; non-consensual contact or non-consensual behavior of any kind; sharing private community content outside the community without consent; fraudulent or unauthorized use of payment methods; misrepresentation of your identity, eligibility, or membership status; illegal activity on or through the Services; and any behavior that creates a meaningful risk to the safety of the community.

Dark Tantra Temple decides whether conduct has violated these standards based on the information available to us at the time. Our determinations are made in our reasonable discretion. We may notify you of the determination, and we may decline to share details where doing so would compromise the safety of another community member.

13. Intellectual Property

The Services, including the website, the member portal, the courses we publish, the original writing, photography, design, software, and the "Dark Tantra Temple" name and marks, are the property of Dark Tantra Temple LLC or our licensors. We grant you a personal, non-transferable, revocable license to access and use the Services for their intended purpose in accordance with these Terms.

When you submit content to the Services, including profile information, application answers, event feedback, testimonials, or messages to administrators ("Member Content"), you retain ownership of your Member Content. You grant Dark Tantra Temple a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and use your Member Content for the purposes of providing and improving the Services, of communicating with the community, and of evaluating your application or participation. You represent that you have the rights necessary to grant this license.

You may not copy, reproduce, modify, distribute, publicly display, scrape, reverse-engineer, or create derivative works based on the Services or on our content, except as expressly permitted by these Terms or by applicable law.

14. Termination

Dark Tantra Temple may suspend or terminate your access to the Services at any time, with or without notice, for cause (including violation of these Terms, of our Privacy Policy, or of our Community Policy, fraud, non-payment, or behavior that places the community at risk) or for our convenience. Where reasonably possible and where it is not contrary to community safety, we will notify you of the reason for termination.

You may terminate your account at any time from your account settings page at /portal/settings, or by contacting us at temple@mail.darktantratemple.com. When you do, we anonymize the personal information associated with your account while retaining the underlying transaction, refund, voucher, and commission records in anonymized form to satisfy our legal, tax, and accounting obligations, as described in Section 7 of our Privacy Policy.

On termination, your access to the Services, your membership benefits, any pending applications, any voucher balance, and any pending affiliate commissions are forfeited. Outstanding payment obligations to Dark Tantra Temple survive termination.

15. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DARK TANTRA TEMPLE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE SERVICES. THIS INCLUDES, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, free of errors, free of viruses or other harmful components, or that any content will be accurate, complete, or current. You use the Services at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the maximum extent permitted by law.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DARK TANTRA TEMPLE, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF DARK TANTRA TEMPLE TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) ONE HUNDRED UNITED STATES DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID TO DARK TANTRA TEMPLE IN THE TWELVE MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted by law and our liability is limited to the smallest amount permitted by that law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Dark Tantra Temple, its affiliates, and their respective officers, directors, employees, and agents from and against any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any rights of a third party, your Member Content, or any conduct of yours that would, if true, breach the representations and warranties you make in these Terms.

We may, at our option, assume the defense of any matter for which you are required to indemnify us. If we do, you agree to cooperate with our defense. You may not settle any matter for which you are required to indemnify us without our prior written consent.

18. Dispute Resolution

Please read this Section 18 carefully. It affects your legal rights. It requires the use of binding arbitration for most disputes, with a thirty-day opt-out window, a small-claims carve-out, and a class-action waiver. In this Section, "Dispute" means any claim, controversy, or dispute between you and Dark Tantra Temple arising out of or relating to these Terms or the Services.

A. Informal Resolution (Mandatory First Step)

Before commencing arbitration or any court proceeding, you and Dark Tantra Temple agree to try in good faith to resolve any Dispute informally for at least thirty (30) days. The thirty-day period begins when you send written notice of the Dispute to temple@mail.darktantratemple.com with a clear description of the Dispute, the relief you are seeking, and your contact information, or when Dark Tantra Temple sends a comparable written notice to the email address associated with your account. During that thirty-day period, both parties will make a good-faith effort to resolve the Dispute through direct discussion.

Compliance with this informal-resolution step is a condition precedent to commencing arbitration or filing any court proceeding (other than a small-claims matter under Subsection D).

B. Binding Arbitration

If a Dispute is not resolved through informal resolution within thirty days, then, subject to Subsections C and D, the Dispute will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules then in effect, as modified by these Terms. The AAA Consumer Arbitration Rules and instructions for filing are available at adr.org.

The arbitration will be conducted in Houston, Harris County, Texas, or by remote video, at the election of the party initiating arbitration. The arbitrator may award the same remedies that a court could award in an individual action, subject to the limitations in these Terms, including Section 16. The arbitrator will follow Texas law and the Federal Arbitration Act. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

AAA filing, administrative, and arbitrator fees are governed by the AAA Consumer Arbitration Rules and the AAA fee schedule. The arbitrator may reallocate fees as permitted by the AAA rules and applicable law.

By agreeing to arbitration in this Subsection B, both you and Dark Tantra Temple waive the right to a jury trial and the right to participate in a class, collective, or representative proceeding (subject to Subsection E).

C. Thirty-Day Opt-Out Window

You may opt out of the arbitration agreement in Subsection B by sending written notice to temple@mail.darktantratemple.com within thirty (30) days after you first accept these Terms. The notice must use the subject line "Arbitration Opt-Out" and include your name, the email address associated with your account, and a statement that you are opting out of the arbitration agreement. If we do not receive a compliant opt-out notice within that thirty-day window, you are deemed to have accepted the arbitration agreement.

An opt-out applies only to the arbitration agreement in Subsection B. It does not affect any other provision of these Terms, including the class-action waiver in Subsection E, the small-claims carve-out in Subsection D, or the choice of governing law and forum in Section 19. If you opt out, Disputes proceed in court in accordance with Section 19, subject to the informal-resolution requirement in Subsection A.

D. Small-Claims Carve-Out

Regardless of whether you have opted out under Subsection C, either you or Dark Tantra Temple may bring an individual action in a small-claims court of competent jurisdiction for any Dispute that is within the jurisdictional limits of that small-claims court. The Texas small-claims jurisdictional limit applicable as of the effective date of these Terms is $20,000; if the limit changes, the limit in effect at the time of filing controls.

If a Dispute is filed in arbitration or in another court and is later determined to be within small-claims jurisdiction, either party may elect to have the matter moved to small-claims court.

E. Class-Action Waiver

To the fullest extent permitted by law, you and Dark Tantra Temple agree that Disputes will be resolved only on an individual basis and not as a plaintiff or class member in any purported class action, collective action, consolidated action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding.

If a court or arbitrator determines that the class-action waiver in this Subsection E is unenforceable as to any particular claim, that claim, and only that claim, will proceed in a court of competent jurisdiction under Section 19; the remainder of this Section 18, including the arbitration agreement in Subsection B for all other claims, will remain in full force and effect.

19. Governing Law and Forum

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, and by applicable federal law. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement in Section 18.

Subject to Section 18, any court proceeding arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Harris County, Houston, Texas. Each party consents to the jurisdiction of those courts.

20. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of the page. If we make material changes, we will provide additional notice by email to the address on your account and by posting a notice inside the member portal.

Your continued use of the Services after a change takes effect means that you accept the updated Terms. Material changes do not apply retroactively to Disputes that arose before the change takes effect.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy at darktantratemple.com/privacy and our Community Policy at darktantratemple.com/community-policy, constitute the entire agreement between you and Dark Tantra Temple regarding the Services and supersede any prior or contemporaneous agreements between us on the same subject, except for any separate written agreement signed by an authorized representative of Dark Tantra Temple.

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, sale of assets, or by operation of law.
